1. Acceptance of Terms
By downloading, installing, or using Cosmos Focus, you agree to these Terms of Use. These Terms are between you and Cosmos One. If you do not agree, do not use the App.
2. Description of the App
Cosmos Focus is an Android focus timer app. It lets you configure a focus duration, enter a local goal, run and pause focus sessions, keep the screen awake while focusing, play bundled or generated focus sounds, download optional focus clips, view audio credits, and export local diagnostic logs when needed.
3. Eligibility and Age Requirement
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you should use the App with parent or guardian involvement. You must not use the App where prohibited by law.
4. User Content and User Data
You retain ownership of content you enter into the App, including focus goals and support messages. You are responsible for the content you enter or share and must have the right to use it.
Cosmos Focus stores app data locally unless you choose to export, share, back up, or send it through an app feature or third-party service.
5. Acceptable Use
You must not use the App to break the law, harm others, infringe rights, misuse third-party services, interfere with app operation, reverse engineer the App except where permitted by law, submit unlawful or privacy-invasive content, or attempt unauthorised access to any system.
6. Licence Grant
Cosmos One grants you a limited, non-exclusive, non-transferable, revocable licence to use Cosmos Focus for personal use in accordance with these Terms. You must not copy, modify, distribute, sell, sublicense, exploit, or remove notices from the App except where permitted by law.
7. Intellectual Property
Cosmos One owns the App, design, code, branding, and related materials unless stated otherwise. Third-party components and audio assets remain owned by their respective owners and are governed by their own licences. Your content remains yours.
8. Third-Party Services
- Google Play and Android: App distribution, operating system features, and Android sharing intents.
- Freesound: Optional downloadable preview audio clips when selected.
- OpenGameArt and Wikimedia Commons: Source and licence references for some bundled or credited audio assets.
- User-selected share targets: Apps you choose for diagnostics or support messages.
Third-party services are governed by their own terms and privacy policies. Cosmos One is not responsible for third-party service availability or content.
9. Privacy
Your use of the App is also governed by our Privacy Policy. The App is local-first, does not require an account, and does not include detected ads, billing, analytics SDKs, AI providers, or external crash-reporting SDKs. Diagnostic logs stay local unless you choose to share them.
10. Data Storage and Security
App data is stored primarily on your device. You are responsible for maintaining device security and backups. Local data may be lost if you clear app data, uninstall the App, reset your device, or disable relevant system features. No storage or transmission method can be guaranteed to be completely secure.
11. Disclaimers
The App is provided "as is" and "as available". We do not guarantee uninterrupted or error-free operation, compatibility with every device or Android version, availability of third-party audio hosts, or that focus sounds will be suitable for every user. The App is not medical, psychological, productivity, legal, financial, or other professional advice.
12. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law in Schedule 2 of the Competition and Consumer Act 2010 (Cth) or any other applicable law that cannot be excluded, restricted, or modified by agreement.
Where we are permitted to limit our liability under the Australian Consumer Law, our liability is limited, at our option, to resupplying the relevant service or paying the cost of having the relevant service supplied again.
13. Limitation of Liability
To the maximum extent permitted by law, Cosmos One is not liable for indirect, incidental, consequential, special, or punitive loss, loss of data, loss of profits, service interruption, device configuration issues, third-party service failures, or misuse of the App. This does not limit rights that cannot be excluded under Australian law.
14. Indemnity
You agree to indemnify Cosmos One against claims, losses, liabilities, damages, costs, and expenses arising from your breach of these Terms, misuse of the App, unlawful content, infringement of third-party rights, or unauthorised processing or sharing of data.
15. Suspension and Termination
You may stop using the App at any time and may uninstall it or clear local app data. Cosmos One may suspend or terminate access to features where necessary for misuse, breach, security risk, abuse, legal requirement, or discontinued service support. Local data may remain on your device until you delete it.
16. Changes to the App or Service
Cosmos One may change, suspend, or remove features. Compatibility, third-party services, and audio source availability may change over time.
17. Changes to These Terms
We may update these Terms from time to time. The Last Updated date will show when they changed. Continued use after changes means acceptance where legally appropriate. The App may ask you to review and accept updated documents again.
18. Governing Law
These Terms are governed by the laws of Australia, without regard to conflict of law principles. Any disputes arising under or in connection with these Terms are subject to the courts of Australia.
Nothing in these Terms limits any rights you may have under the Australian Consumer Law or other mandatory consumer protection laws that apply to you.
19. Severability
If any provision of these Terms is invalid or unenforceable, the remaining provisions continue in effect.
20. Entire Agreement
These Terms and the Privacy Policy form the entire agreement between you and Cosmos One for your use of Cosmos Focus.
