1. Acceptance of Terms

By installing, accessing, or using LumenWrite ("the Extension"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Extension.

These Terms constitute a legal agreement between you and Cosmos One ("we", "us", or "our"). We reserve the right to modify these Terms at any time. Continued use of the Extension after changes constitutes acceptance of the modified Terms.

2. Description of Service

LumenWrite is a Chrome browser extension that provides AI-powered writing assistance. The Extension allows you to:

  • Correct grammar, spelling, and punctuation errors
  • Improve text clarity and flow
  • Translate text to different languages
  • Apply these features to any text field on the web

3. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the Extension in the Google Chrome browser, solely for your personal, non-commercial purposes.

3.1 Restrictions

You may not:

  • Copy, modify, or distribute the Extension
  • Reverse engineer, decompile, or disassemble the Extension
  • Remove any proprietary notices from the Extension
  • Use the Extension for any illegal purpose
  • Use the Extension to generate harmful, misleading, or illegal content
  • Attempt to circumvent usage limits or access controls
  • Use automated means to access the Extension's services
  • Resell or redistribute the Extension's services

4. User Accounts

To use LumenWrite, you must create an account using Google Sign-In. By creating an account, you agree to:

  • Provide accurate and complete information
  • Maintain the security of your account credentials
  • Accept responsibility for all activities under your account
  • Notify us immediately of any unauthorised use

5. User Content

5.1 Your Content

You retain ownership of all text you submit to the Extension for processing ("User Content"). By using the Extension, you grant us a limited license to process your User Content solely for providing the writing assistance services.

5.2 Content Restrictions

You agree not to submit content that:

  • Violates any laws or regulations
  • Infringes on third-party intellectual property rights
  • Contains harmful, threatening, or harassing material
  • Contains personal information of others without consent
  • Is designed to deceive or defraud others

5.3 AI-Generated Output

The Extension uses AI to process and improve your text. You acknowledge that:

  • AI output may not always be accurate or appropriate
  • You are responsible for reviewing and approving all output before use
  • We do not guarantee the quality or accuracy of AI suggestions

6. Free and Premium Services

6.1 Free Tier

The free version of the Extension includes limited usage. Free tier limitations are subject to change.

6.2 Premium Features

Premium features provide enhanced usage limits and are available through subscription.

6.3 Payments and Refunds

Subscriptions are processed through our payment partners. Refund requests are handled according to the applicable refund policy.

7. Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information. By using the Extension, you consent to our privacy practices.

8. Data Processing

8.1 Text Processing

When you use LumenWrite, the text you submit is sent to our AI service for processing. This is necessary to provide the writing assistance features.

8.2 Data Retention

We do not permanently store the text you submit for processing. Text is processed in real-time and not retained after the response is delivered.

8.3 Local Storage

The Extension stores settings and preferences locally in your browser using Chrome's storage API.

9. Third-Party Services

The Extension integrates with third-party services:

  • Google Sign-In: For authentication via OAuth 2.0
  • Cosmos API: For AI-powered text processing

Your use of these services is subject to their respective terms and policies.

10. Intellectual Property

The Extension, including its code, design, features, and content (excluding User Content), is owned by Cosmos One and protected by intellectual property laws. Our name, logo, and related marks are our trademarks.

11. Acceptable Use

You agree to use the Extension only for lawful purposes and in accordance with these Terms. You agree not to:

  • Use the Extension to generate spam or unsolicited messages
  • Impersonate any person or entity
  • Interfere with or disrupt the Extension or its servers
  • Attempt to gain unauthorised access to any systems
  • Use the Extension in any way that could damage our reputation

12. Disclaimer of Warranties

THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY OF AI-GENERATED CONTENT
  • UNINTERRUPTED OR ERROR-FREE SERVICE

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMOS ONE SHALL NOT BE LIABLE FOR:

  • Any indirect, incidental, special, consequential, or punitive damages
  • Loss of data, profits, or business opportunities
  • Any damages arising from your use or inability to use the Extension
  • Errors or inaccuracies in AI-generated content
  • Consequences of relying on AI suggestions

Our total liability shall not exceed the amount you paid for the Extension in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless Cosmos One from any claims, damages, losses, or expenses arising from:

  • Your use of the Extension
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your User Content
  • Content generated using the Extension

15. Termination

We may terminate or suspend your access to the Extension at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination:

  • Your right to use the Extension ceases immediately
  • You must uninstall the Extension
  • Local settings stored in your browser may remain until cleared

16. Changes to the Extension

We reserve the right to modify, suspend, or discontinue the Extension (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cosmos One regarding the Extension and supersede all prior agreements.
