1. Acceptance of Terms
By downloading, installing, or using MedDoc Scanner ("the App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms constitute a legal agreement between you and Cosmos One ("we", "us", or "our"). We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
2. Description of Service
MedDoc Scanner is a mobile application designed to help you securely scan, organise, and manage medical documents. The App allows you to:
- Scan and capture medical documents using your device camera
- Organise documents into categories (Specialist Referrals, Test Referrals, Test Results, Receipts)
- Extract text from documents using OCR technology
- Search across your document collection
- Create encrypted backups of your documents
3. Important Disclaimers
3.1 Not Medical Advice
MedDoc Scanner is a document storage and organisation tool only. The App does not provide medical advice, diagnosis, or treatment recommendations. Always consult with qualified healthcare providers for medical decisions.
3.2 Regulatory Compliance
MedDoc Scanner has not been audited for compliance with specific healthcare regulatory frameworks. The App implements strong security practices, but:
- We are not a covered entity under health privacy regulations
- We have not obtained formal compliance certifications
- You are responsible for determining if the App meets your specific regulatory requirements
- Consult with your legal or compliance advisors if you have specific regulatory obligations
4. License Grant
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a mobile device that you own or control, solely for your personal, non-commercial purposes.
4.1 Restrictions
You may not:
- Copy, modify, or distribute the App
- Reverse engineer, decompile, or disassemble the App
- Remove any proprietary notices from the App
- Use the App for any illegal purpose
- Transfer your license to another party
- Use the App to store documents you do not have the right to possess
5. User Accounts and Security
The App uses PIN-based and optional biometric authentication stored locally on your device. You are responsible for:
- Maintaining the confidentiality of your PIN
- All activities that occur under your authentication
- Maintaining the security of your device
- Managing your backup passwords
Important: If you forget your PIN and do not have a backup, your encrypted data cannot be recovered. We do not have access to your encryption keys.
6. User Content
You retain ownership of all documents and content you scan and store using the App ("User Content"). By using the App, you represent that:
- You have the right to scan and store the documents
- Your User Content does not violate any laws or third-party rights
- You are solely responsible for your User Content
- You understand the sensitivity of medical documents
7. Free and Premium Services
7.1 Free Tier
The free version of the App includes limited features, including a monthly scan limit. Free tier limitations are subject to change.
7.2 Premium Features
Premium features are available through in-app purchases or subscription. Premium features include unlimited scans and priority support.
7.3 Payments and Refunds
All purchases are processed through Google Play. Refund requests are handled according to Google Play's refund policy. We do not have access to your payment information.
8. Privacy
Your privacy is critically important to us, especially given the sensitive nature of medical documents. Please review our Privacy Policy, which explains how we protect your information. Key points:
- All data is stored locally on your device
- Documents are encrypted with AES-256
- We never transmit your documents to our servers
- You control all your data
9. Data Storage and Encryption
9.1 Local-Only Storage
All documents, metadata, and extracted text are stored exclusively on your device. We do not operate servers that store your medical documents.
9.2 Encryption
The App uses AES-256 encryption for all documents and metadata. Encryption keys are protected by Android Keystore and never leave your device.
9.3 Backup Responsibility
If you create encrypted backups, you are responsible for:
- Storing backup files securely
- Remembering your backup password
- Managing backup file distribution
10. Third-Party Services
The App integrates with third-party services:
- Google Play Billing: For processing premium purchases
- Google ML Kit: For on-device document scanning and OCR (no data transmitted to Google)
Your use of these services is subject to their respective terms and policies.
11. Intellectual Property
The App, including its code, design, features, and content (excluding User Content), is owned by Cosmos One and protected by intellectual property laws. Our name, logo, and related marks are our trademarks.
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF OCR RESULTS
- SUITABILITY FOR MEDICAL RECORD KEEPING
- COMPLIANCE WITH HEALTHCARE REGULATIONS
We do not warrant that the App will be uninterrupted, error-free, or completely secure.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMOS ONE SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of data, including medical documents
- Any damages arising from your use or inability to use the App
- Failure to meet regulatory requirements
- Decisions made based on stored documents
Our total liability shall not exceed the amount you paid for the App in the twelve (12) months preceding the claim.
14. Indemnification
You agree to indemnify and hold harmless Cosmos One from any claims, damages, losses, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Your User Content
- Your failure to maintain adequate security
15. Termination
We may terminate or suspend your access to the App at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
Upon termination, your right to use the App ceases immediately. Your locally stored data remains on your device until you delete it or uninstall the App.
16. Changes to the App
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Australia, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Australia.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Cosmos One regarding the App and supersede all prior agreements.
