Terms of Service

1. Acceptance of Terms

By accessing or using any service operated by Cosmos One ("we", "our", or "us"), including the website at cosmosone.cloud and any applications distributed under the Cosmos One brand, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our services.

You must be at least 13 years of age to use our services.

2. Description of Services

Cosmos One operates a family of AI-powered productivity tools and the infrastructure that supports them:

  • Cosmos Services: A cloud-based API platform that provides AI chat, authentication, subscription management, and usage tracking to registered applications
  • Consumer applications: Including Cosmos Scanner, Cosmos Calendar, LumenWrite, and others available on Android, Chrome Web Store, and the web
  • Cosmos One Website: The homepage at cosmosone.cloud, including the account management and deletion features

Individual applications may have supplementary terms specific to their functionality. In the event of a conflict between these Terms and any app-specific terms, these Terms shall prevail unless the app-specific terms explicitly state otherwise.

3. User Accounts and Authentication

3.1 Google Sign-In

Our services use Google OAuth for authentication. When you sign in with your Google account:

  • We receive your Google Account ID, email address, display name, and profile picture
  • We never receive or store your Google password
  • We request only non-sensitive OAuth scopes (openid, email, profile)
  • Some individual apps may request additional Google API scopes for their specific functionality

3.2 Account Responsibilities

You are responsible for:

  • Maintaining the security of your Google account
  • All activity that occurs under your account
  • Notifying us promptly of any unauthorised use

3.3 Account Deletion

You may request deletion of your account and associated data at any time:

  1. Visit https://cosmosone.cloud/account-deletion
  2. Sign in with your Google account
  3. Select the app and submit your request

We will process your deletion request within 30 days. For details on what data is deleted, see our Privacy Policy.

4. Subscriptions and Billing

4.1 Free and Paid Tiers

Some Cosmos One apps offer both free and premium tiers. Free tiers may include usage limits (quotas) and rate limiting.

4.2 Subscription Terms

  • Subscriptions are managed through RevenueCat and processed via Google Play (Android), App Store (iOS), or Stripe (web and Chrome)
  • Payment terms, renewal, and cancellation are governed by the respective platform's policies
  • We do not directly handle credit card or payment information

4.3 Trial Periods

Some apps may offer a trial period (typically 7 days). After the trial ends, continued access to premium features requires an active subscription.

4.4 Refunds

Refund requests are handled by the platform through which the purchase was made (Google Play, App Store, or Stripe). We do not process refunds directly.

5. AI-Powered Features

5.1 Important Disclaimers

Our apps use AI models provided by third-party services (OpenAI, Anthropic, and others). You acknowledge that:

  • AI-generated content may contain errors, inaccuracies, or biases
  • AI responses should not be treated as professional advice (medical, legal, financial, or otherwise)
  • You are responsible for reviewing and verifying any AI-generated content before relying on it
  • AI model availability and capabilities may change without notice

5.2 AI Provider Terms

By using AI features in our apps, you also agree to the usage policies of the underlying AI providers:

5.3 Prohibited Uses

You must not use AI features in our apps to:

  • Generate illegal, harmful, or abusive content
  • Attempt to extract training data or model weights
  • Circumvent usage limits or rate restrictions
  • Use outputs in ways that violate the AI providers' usage policies

6. User Content

6.1 Ownership

You retain ownership of all content you create, upload, or submit through our services, including chat prompts, documents, and other materials.

6.2 License Grant

By submitting content through our services, you grant Cosmos One a limited, non-exclusive license to process that content solely for the purpose of providing the requested service (e.g., forwarding a chat prompt to an AI provider to generate a response). We do not claim any ownership of your content.

6.3 Your Responsibilities

You are responsible for ensuring that your content does not:

  • Violate any applicable laws or regulations
  • Infringe on the intellectual property rights of others
  • Contain malicious code or harmful material

7. Privacy

Your use of our services is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information, including Google user data.

Our use of Google user data complies with the Google API Services User Data Policy, including the Limited Use requirements.

8. Intellectual Property

8.1 Our Property

The Cosmos One name, logo, website design, application code, and all associated intellectual property are owned by Cosmos One. You may not copy, modify, distribute, or create derivative works from our intellectual property without prior written permission.

8.2 Open Source

Some of our applications may incorporate open-source components or AI models with specific licences. These components remain subject to their respective licence terms.

9. Acceptable Use

You agree not to:

  • Use our services for any illegal purpose
  • Attempt to gain unauthorised access to our systems or other users' accounts
  • Interfere with or disrupt the operation of our services
  • Reverse engineer, decompile, or disassemble our software (except as permitted by law)
  • Use automated tools to scrape, crawl, or extract data from our services
  • Impersonate another person or entity
  • Circumvent usage quotas, rate limits, or other technical restrictions

10. Service Availability

10.1 No Guarantee

We strive to maintain high availability but do not guarantee uninterrupted access to our services. Services may be temporarily unavailable due to maintenance, updates, or factors beyond our control.

10.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of our services at any time. For significant changes affecting paid subscribers, we will provide reasonable advance notice.

11. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT:

  • Our services will meet your specific requirements
  • Our services will be uninterrupted, timely, secure, or error-free
  • AI-generated content will be accurate, complete, or reliable
  • Any errors in our services will be corrected

Australian Consumer Law: Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) or any other applicable law that cannot be excluded, restricted, or modified by agreement.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COSMOS ONE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM:

  • Your access to or use of (or inability to access or use) our services
  • Any conduct or content of any third party on our services
  • Any content obtained from our services, including AI-generated content
  • Unauthorised access, use, or alteration of your content

Our total liability for any claims arising from or relating to these Terms or our services shall not exceed the amount you paid to Cosmos One in the twelve (12) months preceding the claim.

13. Indemnification

You agree to indemnify, defend, and hold harmless Cosmos One and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with:

  • Your access to or use of our services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Your content submitted through our services

14. Termination

14.1 By You

You may stop using our services at any time. To delete your account and data, follow the process described in Section 3.3.

14.2 By Us

We may suspend or terminate your access to our services at any time, with or without cause and with or without notice, including if we reasonably believe you have violated these Terms.

14.3 Effect of Termination

Upon termination, your right to use our services ceases immediately. Sections that by their nature should survive termination (including Disclaimer of Warranties, Limitation of Liability, and Indemnification) shall survive.

15. Changes to These Terms

We may update these Terms from time to time. When we make changes, we will update the "Last Updated" date at the top of this page. Your continued use of our services after changes are posted constitutes your acceptance of the revised Terms.

For material changes, we will provide prominent notice (such as a banner on our website).

16. Governing Law

These Terms are governed by and construed in accordance with the laws of Australia. Any disputes arising from these Terms or your use of our services shall be subject to the exclusive jurisdiction of the courts of Australia.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy and any app-specific terms, constitute the entire agreement between you and Cosmos One regarding your use of our services.
